RESUMO: Este estudo tem por objetivo analisar e comparar dois processos judiciais ajuizados perante
a Primeira Instância do Tribunal Regional do Trabalho com jurisdição no Estado de Minas
Gerais, quanto à ocorrência de assédio moral sofrido por docentes de instituições privadas de
ensino superior. A base teórica foi ancorada na literatura especializada (HIRIGOYEN, 2011)
sobre assédio moral. Visa investigar as ocorrências de assédio moral levadas ao Judiciário e
as respectivas decisões relativas aos dois casos concretos. Em termos metodológicos, a
pesquisa é descritiva e documental. Analisa qualitativamente os dados em um estudo
comparativo de caso, tendo como unidade de análise o assédio moral e a observação dos
dois processos judiciais de onde se extraíram os dados para análise. O ambiente educacional
é propício à ocorrência do assédio moral e o Estado não pode se omitir às condutas
praticadas, pois, elas são altamente lesivas à saúde da vítima, tanto no aspecto físico quanto
psíquico, com consequências severamente danosas para os indivíduos assediados. Os
resultados apontaram para condutas institucionalizadas por parte das organizações de ensino
e praticadas reiteradamente. Apontam também para a dificuldade de as vítimas de assédio
moral comprovar os fatos perante o Judiciário que adota, conforme o órgão julgador, posições
diversas quanto à valoração da prova e a comprovação do assédio moral. Isto implica, dentre
tantos outros sofrimentos suportados pela vítima, não ser esta capaz de revelar a realidade
vivida ao longo do contrato de trabalho, mesmo mediante provas, o que faz com que o dano
não seja reparado e o assediador não seja punido, deixando a vítima impotente frente à
situação vivida, o que é descrito pela teoria.

ABSTRACT: This study aims to analyze and compare two lawsuits filed before the First Instance of the
Regional Labor Court with jurisdiction in the State of Minas Gerais, regarding the occurrence
of psychological harassment suffered by teachers of private higher education institutions. The
theoretical basis was anchored in the specialized literature (HIRIGOYEN, 2011) on bullying. It
aims to investigate the occurrences of psychological harassment brought to the Judiciary and
the respective decisions relating to the two specific cases. In methodological terms, the
research is descriptive and documentary. It qualitatively analyzes the data in a comparative
case study, having as its unit of analysis moral harassment and the observation of the two
lawsuits from which the data were extracted for analysis. The educational environment is
conducive to the occurrence of moral harassment and the State cannot omit the behaviors
practiced, as they are highly harmful to the victim’s health, both physically and mentally, with
severely harmful consequences for the harassed individuals. The results pointed to
institutionalized behavior by educational organizations and practiced repeatedly. They also
point to the difficulty of victims of psychological harassment to prove the facts before the
Judiciary, which adopts, according to the judging body, different positions regarding the
assessment of evidence and proof of moral harassment. This implies, among many other
sufferings suffered by the victim, not to be able to reveal the reality experienced throughout
the employment contract, even through evidence, which means that the damage is not
repaired and the harasser is not punished, leaving the victim powerless in the face of the
situation experienced, which is described by theory.
