Resumo: Esta dissertação teve por objetivo conhecer as dimensões organizacionais presentes na nova legislação dos motoristas profissionais transportadores de cargas, especificamente na atividade do cegonheiro, que transporta veículos ao longo do território brasileiro. O estudo visou, sobretudo, apreender os impactos dessa nova legislação na saúde desses profissionais. O campo de pesquisa, indicado pelo sindicato da categoria, foi uma empresa privada de médio porte, que opera na área de logística, situada em Betim – MG, com quadro de 33 empregados, sendo 19 cegonheiros, todos contratados pelo regime da Consolidação das Leis do Trabalho (CLT). O tipo de pesquisa foi descritivo, de abordagem qualitativa, utilizando como método o estudo de caso. A unidade de análise e os sujeitos de pesquisa foram a empresa e os cegonheiros. O instrumento de coleta de dados foi um roteiro semiestruturado para entrevista individual, composto por perguntas abertas e mais abrangentes, mas com o foco nas questões relativas aos períodos anterior e posterior à nova legislação. Todas as entrevistas foram gravadas, transcritas e submetidas a uma análise de conteúdo, na modalidade de análise temática, resultando na definição dos principais conteúdos identificados nas respostas dadas pelos participantes. Foram entrevistados seis cegonheiros, o gerente operacional, o dono da empresa e a gerente de saúde e segurança do trabalho da clínica terceirizada. Por meio da análise dos resultados, observou-se que, nessa empresa, o tempo de trabalho é bem definido, considerando a quilometragem, a condição das estradas e as pausas. As sobrejornadas são esporádicas, reduzindo significativamente o impacto da atividade na fadiga dos motoristas. As pausas são realizadas e contribuem como mecanismo de regulação, prevenção de doenças e até mesmo de acidentes, pois os motoristas trabalham descansados sem necessidade de uso de substâncias psicoativas para se manterem acordados. Esse modelo de organização bem definida e controlada fez com que um dos donos da empresa participasse da elaboração da nova lei em Brasília. Embora os resultados obtidos nesta pesquisa tenham revelado o lado positivo da configuração da jornada de trabalho dos cegonheiros, é possível que essa realidade não seja a mesma encontrada entre outros motoristas de caminhão que estejam submetidos a outras empresas ou mesmo com próprio trabalho autônomo, mesmo com o advento da nova lei do motorista profissional.

Abstract: This dissertation has as an objective to get to know the present organizational dimensions in the new legislation of the professional loads transportation truck drivers, specifically in the activity of the stork drivers, whom transport vehicles along the Brazilian territory. The study aimed, above all, to learn all the impacts of this new legislation in the health of these professionals. The research field, indicated by the category union, was a private company of midsize, that operates in the logistic field, based in Betim – MG, with a board of 33 employees, being 19 stork drivers, all hired on the Work Laws Consolidation (WLC) regimen. The type of research was descriptive, of a qualitative approach, using the method of case study. The analysis unit and the research subjects were the employer and the stork drivers. The instrument of data collection was a semi structured script for an individual interview, composed of in-depth open question, but with the focus in the questions of the previous periods and rear to the new legislation. All the interviews were recorded, transcribed and submitted to a content evaluation, in the genre of thematic analysis, resulting in the definition of the main identified contents identified in the answers given by the participants. Were interviewed 6 stork drivers, the operation manager, the company owner and the health and safety manager from the third-party clinic. By means of the analysis results, It was observed that, in this company, the work hours are well set, considering the mileage, the roads conditions and the breaks. The extra-hours are infrequent, reducing significantly the impact of the activity over the fatigue of drivers. The workers breaks are conducted and contribute with the regulation mechanism, diseases prevention and even accidents, because the drivers work rested without the need of using psychoactive substances to keep them awake. This model of well defined and controlled organization caused that one of the employers participated in the elaboration of the new law in Brasilia. Though the obtained results in this study had unveiled the positive side of setting the work journey of stork drivers, it`s possible that this reality does not reflect the same encountered among other lorry drivers that are submitted to other companies or even with the advent of the new professional driver law.
